Petitioner seeks bail in Kotwali (Tilkamanjhi) P.S.Case No.254 of 2018 registered for the offences under Sections 302, 120(B),34 of the I.P.C. and Section 27 of the Arms Act. Petitioner is named in this case on suspicion as he had taken loan a sum of Rs.7500000/- from the deceased. Submission of the learned counsel for the petitioner is that except suspicion there is nothing against him and he is in custody since 21.4.2018 having no criminal antecedent. Further submission is that other co-accused who had been arrested on suspicion has already been granted bail by a co-ordinate Bench of this Court.
Patna High Court Cr.Misc. No.47566 of 2018 (3) dt.20-09-2018 2/2 Heard learned A.P.P. and the informant who opposed the prayer for bail of the petitioner stating that this petitioner is instrumental in killing the deceased by the hard core criminal and once hot talk exchange had taken place between the parties. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur, in Kotwali (Tilkamanjhi) P.S. Case No.254 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
