JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420,120B,467,468,471,363 and 364/34 of the Indian Penal Code.

It is alleged that co accused Gyasuddin Ansari, the father of the petitioner assured the informant to provide employment abroad to two sons of the informant on payment of rupees two lacs fifty thousand and subsequently sixty thousand rupees were given to co accused Gyasuddin Ansari, thereafter the balance money was transferred in the account of the petitioner and Tabassum.

No.34864 of 2015 (2) dt.02-09-2015 2/2 It is submitted by the learned counsel for the petitioner that the sons of the petitioner went abroad, worked there and thereafter they returned. It is further submitted that considering the nature of accusation co accused Gyasuddin Ansari and others have been granted anticipatory vide Cr. Misc. No. 25139 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Raxaul in connection with Palanwa P.S. Case No. 55 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
