Petitioner, already in custody, seeks bail in connection with Rohtas P.S. Case No.90 of 2009, giving rise to Sessions Trial No.421 of 2014, registered under Sections 147, 148, 149, 341, 435, 121, 121A and 124A of the Indian Penal Code as well as under Section 17 of the C.L.A. Act.

Allegation in brief is that the bus of the informant, the driver, was stopped by a large number of extremist group as bandh was declared by them and the bus was set on fire besides some other vehicles and all were raising slogans against the administration.

Learned counsel for the petitioner submits that the informant has named some persons but the petitioner is not

No.11031 of 2018(5) dt.26-07-2018 2/2 named in the FIR and no other witness has named this petitioner, only on the basis of confidential information, the petitioner has been made accused in this case and charge-sheet was submitted in the year 2016 though the petitioner has several antecedents of similar nature but implicated in this case merely on suspicion.

Having considered the aforesaid facts and circumstances and the material against the petitioner, petitioner Vijay Kumar Arya is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-4, Rohtas, Sasaram in connection with Rohtas P.S. Case No.90 of 2009, giving rise to Sessions Trial No.421 of 2014.
