JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-302/34 of the Indian Penal Code.

Petitioners are named in the first information report but they are not assailants rather the informant claims that petitioners and one co-accused Baban Rai instigated the accused Shambhu Rai to assault the deceased and after that, co-accused Shambhu Rai gave Farsa blow, causing death of the deceased. Submission on behalf of petitioners is that petitioners are in jail custody since 22-05-2016 and the investigation against them has already been completed. Petitioners do not have any criminal antecedent.

Considering the above-said facts and circumstances of

No.38900 of 2016 (2) dt.20-09-2016 2/2 the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Taraiya P.S.
