Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR was registered against unknown relating to theft of motorcycle. The said motorcycle was recovered from the possession of three accused persons including the petitioner who were riding on the same. Co-accused Md. Sakil, who was also on the said motorcycle, has already been allowed regular bail by a Coordinate Bench of this Court vide order dated 20.09.2017 passed in Cr. Misc. No. 44587 of 2017 considering the fact that for recovery of the said motorcycle Mufassil P.S. Case No. 249 of 2017 was registered and in that case, petitioner was already on bail.

No.47555 of 2018 (2) dt.20-08-2018 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Samastipur (Muffasil) Police Station Case No. 244 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
