The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young boy of 21 years of age and the informant alleges that his minor sister was kidnapped by the petitioner and Md. Saddam, further father of petitioner assured that his sister would come back by evening, further when she did not return the informant again went to his house when he was threatened.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is

No.41941 of 2022(2) dt.12-12-2022 2/2 next submitted that petitioner and the victim were in love and thus the victim on her own volition had accompanied the petitioner, it is also submitted that the victim has come back and her statement was recorded under Section 164 Cr.P.C., wherein she has not supported the case of the prosecution. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nawada Town P.S. Case No. 717 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
