2. The petitioners apprehend their arrest in connection with Malaypur P.S. Case No. 134/ 2024 dated 14.12.2024 registered for the offence(s) punishable under Section(s) 109(1), 117(4), 126(2), 303(2), 351(3) and 352 of the BNS.
3. As per the prosecution's story, the petitioner No.3, Kaushal Kumar assaulted the informant with a Tangi on her head, the petitioner No.2, Sunita Devi assaulted the mother-inlaw of the informant, Shakuntala Devi with a stick on her head
Patna High Court CR. MISC. No.39080 of 2025(3) dt.03-09-2025 2/3 due to which she sustained head injury and petitioner No.1, Loknath Yadav assaulted the father-in-law of the informant with an iron rod on his leg as a result of which he sustained injuries.
4. The main submissions advanced by the petitioners' counsel are that in the alleged occurrence only three persons are said to have sustained injuries, two of them sustained simple injuries and only one injured person, Shakuntala Devi sustained grievous injury, petitioner No.2, who is specifically alleged to have caused grievous injury to Shakuntala Devi, is a lady and the alleged occurrence took place on account of a land dispute running in between both the parties, who are relatives.
5. Learned APP appearing for the State has opposed the bail prayer of the petitioners.
6. There is serious allegation against the petitioners as they first entered into the house of the informant and then assaulted three persons, one of whom sustained grievous injury on her head, this court is not inclined to release the petitioners on anticipatory bail. Accordingly, their prayer stands rejected.
7. The petitioners are directed to surrender before the court below within three weeks from the date of this order, if they do so, then the learned trial court will decide the prayer for regular bail of the petitioners on the same day of their surrender,
