JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 50 bottles (180 ml. each) were recovered from the possession of the petitioner. Petitioner claims his antecedent to be clean save and except stated in paragraph no.3 which was instituted on the same date and he is in custody since 05.04.2017.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on

Patna High Court Cr.Misc. No.32247 of 2017 (2) dt.13-07-2017 2 / 2 furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Rosera, District, Samastipur in connection with Bibhutipur P.S. Case No. 69/2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
