JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioners and the State.
The petitioners seek bail in a case instituted for the offence under Section 364 of the Indian Penal Code. It is alleged in the written report that the informant suspects that petitioners have kidnapped his nephew, namely, Sonu kumar who is traceless.
It has been submitted that investigation has been completed and charge sheet has been submitted for the offence under section 364 of the Indian Penal Code. It has further been submitted that besides suspicion, there is no allegation of overt act
Patna High Court Cr.Misc. No.344 of 2017 (3) dt.22-02-2017 2/2 against these petitioners.
From the impugned order of learned Vth Additional sessions Judge, Begusarai, it also appears that mere suspicion has been raised against these petitioners in the case diary. The petitioners are in custody since 10.06.2016. It is mentioned in para-3 of bail petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Begusarai, in connection with Bakhri P.S. Case No. 111 of 2016, subject to the condition that both the bailors will be the close relative of the petitioners. (Sanjay Priya, J.) ravi/- U T
