JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken under Sections 498A and 406/34 of the Indian Penal Code and section 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands.

The petitioner and the complainant are present. The complainant is ready to resume the conjugal life but it is submitted by the learned counsel for the petitioner that the petitioner is not

Patna High Court Cr.Misc. No.36356 of 2015 (3) dt.26-11-2015 2/2 ready to accept the offer since the complainant is not the same girl who was approved by the petitioner prior to the marriage. In the circumstances, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Complaint Case No. 2349 of 2014 pending in the court of learned SDJM, Siwan.

This application is disposed of with the aforesaid observation/direction.
