Petitioner seeks regular bail in connection with Khaira PS Case No. 184/2021 registered for the offence punishable under Sections 363, 366(A) of the IPC.
The allegation against the petitioner as per First Information Report is that the petitioner along with other coaccused persons abducted the minor daughter of the informant. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. He next submits that the statement of the victim girl has been recorded under Section 164 CrPC in which she has categorically
Patna High Court CR. MISC. No.50948 of 2021(2) dt.08-04-2022 2/2 stated that she had gone to Dehli along with her friend, i.e., petitioner and the petitioner did not establish any physical relationship with the victim. Petitioner is in custody since 19.06.2021.
Regards being had to the submissions made by the parties and taking into consideration the statement of the victim recorded under Section 164 CrPC and the fact that petitioner is in custody since 19.06.2021 and the charge-sheet in the matter has been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, VAKIL PANDEY be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Saran at Chapra/ the court concerned in connection with Khaira PS Case No. 184/2021.
