Petitioner, already in custody, seeks bail in connection with Nautan P.S. Case No.401 of 2017 registered under Sections 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that it was a case of elopement as the statement of the girl recorded under Section 164 Cr.P.C. categorically reveals the said facts as she has stated that she eloped with Chhote Lal Choudhary; whereas the learned counsel for the State opposes the prayer of bail of the petitioner.

Having considered the aforesaid facts and circumstances, petitioner Jawahir Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
