Petitioner, already in custody, seeks bail in connection with Itarhi P.S. Case No.165 of 2017, giving rise to NDPS Case No.5 of 2017, registered under Sections 8, 20(b)(ii)(B) and 25 of the NDPS Act.
Allegation in brief is that 2.3 Kgs. of Ganja was recovered from the house of the petitioner.
Learned counsel for the petitioner submits that so many persons reside in the house, so the recovery is not from the conscious possession of the petitioner and the quantity of Ganja is very small, only 2.3 Kgs., and the petitioner bears clean antecedent and has been in custody for approximately 11 months.

No.19273 of 2018(5) dt.26-07-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Pramod Keshari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District Judge-cum-Special Judge, NDPS Act, Buxar in connection with Itarhi P.S. Case No.165 of 2017, giving rise to NDPS Case No.5 of 2017 with condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
