====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-10-2017 Heard learned counsel for the petitioner, learned counsel for the State and the learned counsel appearing on behalf of the Bank.

Mr. P.K.Verma, learned Senior Counsel for the Bank, submits that the petitioner was informed for furnishing details but he has not furnished the details in the prescribed format. If he submits details in the prescribed format as intimated to the petitioner by the Bank, the Bank will do the needful and will take

Patna High Court CWJC No.11761 of 2015 (6) dt.11 -10-2017 steps to finalize his admissible dues.

In view of the statement made by Mr. Verma, learned Senior Counsel appearing on behalf of the Bank, this application is disposed of with a direction to the petitioner to furnish the required information in the prescribed format within a period of 15 days from today. The Court expects that the Bank will consider the case of the petitioner and dispose of the claim with regard to post retrial dues if such an application is filed within 15 days from today. The Bank will take further decision to finalize admissible dues of the petitioner within two months from the date of filing of such an application.

It goes without saying that the Bank will pay whatever dues admissible to the petitioner as post retrial benefit within a further period of one month from the date of such decision. It is made clear that if the Bank decides the entitlement of the petitioner and the payments are not made within one month from the date of such decision, the payment of post retrial dues will carry interest at the rate of 9% per annum from the date of retirement to the date of actual payment, which shall be borne out from the pocket of the erring officer.
