29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Hilsa P.S. Case No. 301 of 2021, registered for the offence under Section 363, 366A of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have abducted the daughter of informant for the purpose of marriage.

It is submitted on behalf of petitioner that in the statement, recorded under Section 164 Cr.P.C., the victim girl has denied the prosecution case and has admitted that she has voluntarily gone with this petitioner and other persons to Rajgir for attending a programme. The victim has disclosed her age, as 171⁄2 years, whereas informant has stated the age of victim as 17 years. Petitioner is in custody since 02.07.2021.

Patna High Court CR. MISC. No.51059 of 2021(2) dt.29-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as statement of the victim girl recorded under Section 164 Cr.P.C., the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Hilsa (Nalanda) / concerned court in connection with Hilsa P.S. Case No. 301 of 2021.
