JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 370 of the Indian Penal Code and Section 16 of the Bonded Labour System Abolition Act, 1976.

Allegation against petitioner is that he was arrested at Sitamarhi Railway Station along with six children, who were being taken to Mumbai for working at restaurant. It has been submitted on behalf of petitioner that he is in custody since 22.7.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. He has been made accused due to mistake of fact. Allegation made in the F.I.R. is denied. Parents of the children have not made any complaint against petitioner.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate(Rail), Ist Class,Samastipur, in connection with G.R.P.
