This application is for grant of regular bail in connection with Biroul P.S.Case no.104 of 2018for the offences under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner as per FIR, who happens to be the Director of the School is that son of the informant was reading in that school and residing in the school campus and later on he came to know that the Director and the Principal of the School have assaulted a child and causing his death and on that information when he came and enquired form the school, nothing has been disclosed and later on it was found that a boy was brought in the hospital in the dead condition and he the injury is over the ear and other parts of the body.
Patna High Court Cr.Misc. No.47395 of 2018 (3) dt.20-09-2018 Submission of the learned counsel for the petitioner is that the chargesheet has been submitted under Section 304 of the IPC and no direct allegation is against the petitioner and he is a Director of the School.
Heard learned A.P.P. also, who has opposed the prayer for bail..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge is framed against the petitioner and the trial is commenced, the learned trial court shall release the petitioner on bail in connection with Biroul P.S.Case nO.104 of 2018 to his own satisfaction. With the aforesaid observation, this application is disposed of.
