2. The petitioner is in custody in connection with Vaishali P.S Case No. 31 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 76, 77, 78, 352, 351(2) and 3(5) of the BNS.

3. As per allegation in the FIR, petitioner along with other three accused person were eve teasing the informant and upon refusal, petitioner and the other co-accused persons sexually assaulted her.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. She next submits that petitioner had never eve teased the informant nor

Patna High Court CR. MISC. No.39623 of 2025(3) dt.20-08-2025 2/3 insulted her but due to malice, grudge and with ulterior motive, he has been implicated by her in this case. She further submits there is general and omnibus allegation against the petitioner. The actual fact is that on the relevant date while informant was crossing the road negligently, an accident took place due to which she got injured. Petitioner being co-villager scolded her for her negligent riding the bicycle and made complain to her parent and being annoyed with this, informant has falsely implicated all the accused persons. She further submits that petitioner is in custody since 02.04.2025 having six criminal antecedent.

5. However, learned APP for the State opposes the prayer for regular bail of the petitioner.

On perusal of the FIR, entire case diary and the impugned order dated 09.05.2025, it appears that petitioner had eve teased her and upon refusal, petitioner and other accused persons had assaulted the victim with fist and slaps. They even tried to outrage her modesty and beaten the informant with the butt of the pistol. Considering the serious nature of the offence and antecedent of the petitioner, this Court is not inclined to grant regular bail to the petitioner.
