By way of the present application under Section 482 of the Code of Criminal Procedure (For short "Cr. P.C.), the petitioners seek quashing of the order dated 12.03.2010 passed by the learned Judicial Magistrate-1st Class, Patna in Complaint Case No. 251(C)/10, whereby and whereunder they have been summoned to face trial for the offences punishable under Sections 420, 467, 468, 323, 504 and 341 of the Indian Penal Code. The cognizance of the offence was taken on the basis of the statement of the complainant made on oath under Section
Patna High Court Cr.Misc. No.724 of 2015 (3) dt.02-12-2015 200 of the Cr. P.C. and statements of two inquiry witnesses recorded under Section 202 Cr. P.C.
Neither the statement of the complainant nor the statements of the inquiry witnesses have been brought on record. In that view of the matter, I find it difficult to appreciate the case of the petitioners on merits. Accordingly, the application is dismissed.
The petitioners would be at liberty to file another application in the same subject matter after bringing on record all the relevant documents.
