Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 18.1.2017 passed in Cr. Misc. No.47929 and allegation is of recovery of 3.500 kg. of Ganja from the possession of the petitioner. It is submitted that the petitioner is in custody for about two years and the recovery is only 3.500 kg. ganja, which is not commercial quantity. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.52484 of 2018 (3) dt.12-09-2018 2/2 satisfaction of the learned 4th Additional District & Sessions Judge, Sasaram (Rohtas) in connection with Dehri (Town) P.S.Case no.304/2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
