Petitioner seeks regular bail in connection with Sirdala P.S. Case No.92 of 2017 registered for the alleged offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, the petitioner along with three other accused persons was vending the liquor. On the raid made by the police, 60 liters of Mahua wine kept in different containers were recovered and seized.
It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. No recovery has been made from the conscious physical possession of the petitioner. He has been falsely implicated in this
Patna High Court Cr.Misc. No.29521 of 2017 (02) dt.01-07-2017 2/2 case. There is no specific allegations against the petitioner rather the allegations are general and omnibus in nature. He has been languishing in jail custody since 12.05.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M.-V, Nawada in connection with Sirdala P.S. Case No.92 of 2017.
