The petitioner seeks bail in Singhia P.S. Case No. 49 of 2017 registered under Sections 376 and 511 of the Indian Penal Code.

The petitioner is said to have tried to outrage the modesty of the informant in the night by tearing her attire. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. No offence as alleged ever took place. As a matter of fact, the informant has filed a complaint case bearing Complaint Case No. 391 of 2017 against her husband and in-laws with the allegation, inter alia, that on 03.03.2017, the aforesaid accused persons snatched her ornaments and tried to set her ablaze by

No.29498 of 2017 (2) dt.01-07-2017 2/2 sprinkling kerosene oil and when she rushed to the police station, the police took her signature on a blank paper in collusion of the accused persons of the said case and falsely implicated Bittu Kumar Sahu (the petitioner) and sent him jail. The petitioner has been languishing in custody since 01.04.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rosera, Samastipur in connection with Singhia P.S. Case No. 49 of 2017.
