Petitioner seeks bail in Samastipur (Town) P.S.Case No.188 of 2017 registered for the offences under Sections 379 of the I.P.C.
Allegation as per the F.I.R. is of theft of motor cycle. It has been submitted on behalf of the petitioner that later on the name of the petitioner has come on the basis of the SIM of the informant which has been found to be used in the mobile of the petitioner. He is in custody since 7.5.2018. Heard learned A.P.P. also who opposed the prayer for bail of the petitioner stating that he is accused in one more case. Having heard both sides and in view of the facts and circumstances of the case, stated, I am not inclined to grant bail to
Patna High Court Cr.Misc. No.47635 of 2018 (3) dt.20-09-2018 2/2 the petitioner. The prayer for bail of the petitioner is rejected. However, once charge is framed against the petitioner and the trial is commenced, the learned court below shall release the petitioner on bail to his own satisfaction. This application is disposed of.
