1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 34, 120(B) of the Indian Penal Code read with Section 27 of the Arms Act in connection with S. Tr. No. 1033/2025, arising out of Alamganj P.S. Case No. 1164/2023.
3. The learned counsel for the petitioner submits that the instant bail application has been filed in terms of liberty granted to the petitioner to renew his prayer for bail after framing of charge by an order dated 24.01.2025 in Cr. Miscellaneous No. 74232 of 2024. It is submitted that the
Patna High Court CR. MISC. No.41140 of 2025(2) dt.27-06-2025 2/3 charges against the petitioner has been framed by an order dated 16.05.2025 passed by the learned District and Additional Sessions Judge, 4th Patna City. It is next submitted inadvertently the order framing charge could not be annexed with the bail application.
4. Learned A.P.P. for the State has vehemently opposes the prayer for bail of the petitioner.
5. Considering the submissions made by the learned counsel, also petitioner has no criminal antecedent, let the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with S. Tr. No. 1033/2025, arising out of Alamganj P.S. Case No. 1164/2023.
6. The learned trial court before releasing the petitioner on bail shall verify whether the charges against the petitioner has been framed or not and in the event if it is found that charges has been framed against the petitioner, in that event, he shall be released forthwith.
7. It is further made clear that if the learned trial court comes to the conclusion that petitioner after his release is trying
