JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for offences punishable under Sections 272, 273 of the I.P.C. and Section 30(a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016.

As per allegation, 1584 bottles (180 ml. each), 1200 bottles (375 ml. each), 48 bottles (750 ml. each) and 96 bottles (180 ml. each) of foreign liquor were recovered from the boiler of the petitioners.

Petitioners claim their antecedents to be clean and they are in custody since 30.05.2017.

Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail

Patna High Court Cr.Misc. No.32113 of 2017 (2) dt.13-07-2017 2 / 2 on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge II - cum - Speical Court, Excise, Rohtas at Sasaram in connection with Dinara (Bhanas) P.S. Case No. 86 of 2017.

Further, if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
