This application for anticipatory bail arises out of Bishwambharpur P.S. Case No. 17 of 2016 (G.R. No.1540 of 2016), disclosing offences under Sections 323, 406, 494 and 498(A) of the Indian Penal Code.

Petitioner no.1 is the wife of the brother of the husband of the informant, whereas petitioner no.2 is the married sister of the husband of the informant.

Learned counsel for the petitioners has submitted that evidently the FIR has been registered under Section 156(3) of the Cr. P.C., on the basis of a complaint petition, filed by the

Patna High Court CR. MISC. No.39038 of 2019(2) dt.26-06-2019 2/2 informant. He contends that there is no specific allegation against these petitioners of any torture or demand of dowry and they have been implicated merely because they are family members/related to the deceased's husband of the informant. Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned ACJM-X, Gopalganj in connection with Bishwambharpur P.S. Case No. 17 of 2016 (G.R. No.1540 of 2016), subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
