JUSTICE ARVIND SRIVASTAVA ORAL ORDER 26-10-2021 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner nos. 1 to 3, since during the pendency of this application, they have been arrested. Permission is accorded.

Accordingly, the application of petitioner nos. 1 to 3 is dismissed as withdrawn.

Patna High Court CR. MISC. No.504 of 2021(3) dt.26-10-2021 2/2 Heard learned counsel for the petitioner nos. 4 to 6 and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with K. Nagar P.S. Case No. 180 of 2020 registered under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that similarly situated co-accused have already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 16197 of 2021 on 30.07.2021. Having considered the above facts and circumstances of the case, let the above named petitioner nos. 4, 5 and 6 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case No. 180 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
