JUSTICE SANJAY PRIYA ORAL ORDER 27-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Piro P.S. Case No. 117 of 2003 instituted for the offence under Sections 307, 353, 323, 414, 398/34 of the Indian Penal Code, Section 17 of C.L.A Act, Sections 25(1-b), 26, 27 and 35 of the Arms Act. It has been submitted that petitioner is in custody since 3.8.2016. The co-accused namely, Iliyas Mian @ Mohd. Iliyas with similar allegation has been granted bail by a coordinate Bench of this Court vide order dated 2.5.2008 passed in Cr. Misc. 52821 of 2007. The petitioner is not named in the First Information Report. The petitioner has neither been arrested on the spot nor any incriminating article was recovered from his possession.

No.33284 of 2017 (3) dt.27-07-2017 2/2 As per written report, on the date of occurrence, some members of MCC group armed with gun and rifle started firing on police party and police party also made counter firing to arrest the culprits but culprits succeeded to flee away. During search, one dead body of the terrorist was found.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Piro P.S. Case No. 117 of 2003, subject to the condition that both the bailors will be the close relatives of the petitioner.
