JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Chousa P.S.Case No. 252 of 2017 registered under Sections 379, 406, 420, 467, 471 and 120B/34 of the Indian penal Code.
Allegation in brief is that the informant was robbed of his bag containing ATM Cards, Passbook, and Rs 25000/- cash. The miscreants were riding the motorcycle bearing Registration No. BR-11Z-9360 and later on withdrew Rs 2,24,350/- from the said account for which the passbook was robbed by the accused persons. During investigation the image of the miscreants were captured in the CCTV and it was found that the motorcycle and the image of the miscreants is of the petitioner, learned counsel
Patna High Court Cr.Misc. No.27906 of 2018(4) dt.26-07-2018 2/2 appearing on behalf of the petitioner submits that this case was instituted after lapse of 07 days without any cogent reason or explanation and the petitioner was never put on TIP or nothing was recovered from his possession or any evidence to show that money was withdrawn by him, moreover he has no any antecedent of theft or robbery and he has only one case against him registered under Section 366A of I.P.C.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Nivash Kumar Singh@ Nivas Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Uda Kishanganj, Madhepura in connection with Chousa P.S.
