This is an application for bail in connection with Muzaffarpur Rail P.S. Case No. 63 of 2016 registered for the offences punishable under Sections 401, 414 of the Indian Penal Code and 8/22 of NDPS Act.

Allegation against the petitioner is that he was arrested on suspicion and 128 tablets of Alprox were recovered from his possession and he could not answer satisfactorily for keeping such tablets with him and there is also allegation that he used the tablets in tea or coffee of the passengers and looted their belongings, i.e., mobile, cash, etc. when they became unconscious. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for more than one year having no criminal antecedent. Heard learned APP also.

No.31182 of 2017 (4) dt.18-10-2017 2/2 Having heard both sides and in view of the fact that petitioner has no criminal antecedent and he is in custody for more than one year, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Muzaffarpur, in connection with Muzaffarpur Rail P.S. Case No. 63 of 2016 and before releasing the petitioner the court below has to satisfy the address given by the petitioner as well as address of the bailors, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date and on failure to appear on two consecutive dates without showing any genuine ground or without permission of court, his bail bond shall be cancelled.
