The petitioner apprehends his arrest in Barun P.S. Case No.158 of 2021 registered under Sections 379 and 411 of the Indian Penal Code and Section 21 of the Mines and Minerals (Development & Regulation) Act as well as Section 15 of the Environment Conservation Act, 1986.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the tractor of the petitioner loaded with sand was not found in lifting the sand from the river rather the alleged sand was purchased by the petitioner for personal use. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his
