JUSTICE SUDHIR SINGH ORAL ORDER 18-01-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Nathnagar (Lalmatiya) P.S. case No.240 of 2015 instituted for the offence under Sections 461, 379, 411 of the Indian Penal Code and Sections 12, 2 and 16 of the Antiquity Act, pending in the court of learned A.C.J.M., Bhagalpur.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with the observation 'at this stage'.

A report was called for from the trial court regarding the stage of the case. It has been reported that out of eight witnesses six prosecution witnesses have already been examined and only two official witnesses are left to be examined. The trial is expected to be concluded within a period of three months.

Patna High Court Cr.Misc. No.45916 of 2016 (4) dt.18-01-2017 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to ensure that the trial is concluded within a period of three months from the date of receipt/production of a copy of this order as only two official witnesses are to be examined in the case. The District Magistrate, Bhagalpur and the Senior Superintendent of Police, Bhagalpur are also directed to ensure that the official witnesses are produced on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Bhagalpur and the Senior Superintendent of Police, Bhagalpur.
