The petitioner seeks bail in Belsand P.S. Case No. 201/2018, instituted for offence under Section(s) 363, 365, 302, 201 and 34 of the Indian Penal Code.

It is alleged in the written report that son of informant, namely, Nitesh Kumar got traceless from the house on 10.12.2018 at 5 P.M. The informant raised suspicion that this petitioner along with Chandan Kumar has kidnapped his son. The Addl. District & Sessions Judge, Sitamarhi has mentioned in the impugned order that dead body of son of informant has been recovered from the bank of river. Case diary has been received. In the entire case diary besides suspicion there is no allegation of overt act against this

Learned counsel for petitioner has submitted that mere suspicion has been raised against this petitioner. Petitioner is in custody since 14.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Belsand P.S. Case No. 201/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
