JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being father of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A/302/34 of the Indian Penal Code. Accusation is of killing the daughter of the informant after 17-18 years of marriage.

It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the entire in-laws family including the petitioner. On conclusion of investigation, the petitioner was not sent up for trial and only husband of the victim was charge-sheeted for the offences under section 302 IPC but the learned Magistrate differing with the final form took cognizance and issued processes against the petitioner also. No.36432 of 2015 (2) dt.27-08-2015 2/2 petitioner was not sent up for trial and the charge-sheet was accepted, and as submitted by learned counsel for the petitioner the husband of the victim is in custody, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.87 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
