Heard Mr. Kanhaiya Prasad Singh, learned Senior counsel appearing on behalf of the petitioner and learned Addl. Public Prosecutor, appearing on behalf of the State. The petitioner seeks bail in connection with Jakkanpur P.S. Case No. 168 of 2016, registered for the offences punishable under Section 302/34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 13.12.2016, passed in Cr. Misc. No. 43144 of 2016. Learned counsel for the petitioner submits that the informant alleged that husband of the petitioner called the petitioner and on such the petitioner started to assault the deceased

Doctor found the injury nos. 1 and 3 simple in nature. It transpired during the course of investigation that the deceased had entered into the house of the petitioner with bad intention to outrage her modesty. The husband of the petitioner namely Shri Sumit Dayal Singh @ Monu Singh has already been granted bail by a bench of this court by order dated 09.05.2017, passed in Cr. Misc. No. 20787 of 2017.

Considering the facts that the husband of the petitioner has already been enlarged on bail and the case of the petitioner almost stands on the same footing as that of her husband and petitioner, being a lady is in jail since 8.7.2016, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Patna in Jakkanpur P.S. Case No. 168 of 2016.
