ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 11.5.2016 in connection with Vaishali P.S. Case No.101 of 2016 registered for the offence under Section 392 of the Indian Penal Code.
Dairy in the present case was called for, which has since been received.
Learned counsel for the petitioner submitted that though the petitioner is not named in the First Information Report, his name has been drawn in on the basis of a confessional statement made before the police by one coaccused Vinay Kumar, who was arrested. It is said Vinay
Patna High Court Cr.Misc. No.40721 of 2016 (3) dt.24-11-2016 Kumar who has taken the name of the present petitioner during the investigation. It is further submitted that no T.I. Parade has been conducted till date.
In view of the aforementioned facts and circumstances and that the petitioner has no criminal antecedents and has been in custody for over six months, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S.
