The petitioner seeks bail in connection with Nardiganj P.S. Case No. 64 of 2016 registered for the offence punishable under Section 302 of the Indian Penal Code.
Allegedly, the petitioner being the husband of Sarswati Devi, the sister of the informant, due to some dispute assaulted her brutally causing injury and when the informant after hearing the cry went there and was bringing her for treatment she succumbed to the injuries.
Submission is of false implication and that the deceased was sleeping on the roof and due to mistake she fell down from the roof and died sustaining injury due to fall from the roof and the petitioner has been made victim of circumstances as he is the husband.
Patna High Court Cr.Misc. No.55755 of 2016 (2) dt.11-01-2017 Learned APP opposes the prayer of bail by submitting that from perusal of the impugned order it reveals that other witnesses have also supported the prosecution version and post mortem report also supports the prosecution version. In the facts and circumstances stated above, considering the allegation attributed against the petitioner this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.
