The petitioner seeks bail in Gopalganj Town P.S. Case No. 107 of 2017 registered under Sections 379, 413 and 414 of the Indian Penal Code.

As per the prosecution case, accused persons were unloading articles from the truck and keeping the same in their house. On chase, one of the accused persons, namely, Noor Hasan was apprehended who divulged that he used to sell the stolen articles to the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner was not apprehended on the spot. Nothing incriminating article has been recovered from the conscious

Patna High Court Cr.Misc. No.28805 of 2017 (2) dt.03-07-2017 2/2 physical possession of the petitioner. His name was surfaced in the case in the confessional statement of the co-accused Noor Hasan. The petitioner has been languishing in custody since 31.03.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 107 of 2017.
