JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 398 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act.

The petitioner and two others were apprehended on suspicion that they were preparing to commit some crime. From the possession of the petitioner a dagger and four cartridges were recovered.

Submission is of false implication on suspicion. Further submission is that the petitioner is in custody since 29.11.2016.

Considering the nature of allegation and the

No.10317 of 2017 (5) dt.03-07-2017 2/2 period undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Bhojpur at Ara/Successor Court, in connection with Jagdishpur P.S. Case No.304 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
