JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-09-2018 This appeal under Section 11(2) of the Probation of Offenders Act (for short 'the Act') has been filed on behalf of the appellants who have extended benefits of Section 4 of the Act after recording the judgment of conviction dated 16.04.2018 passed by the learned 5th Additional Sessions Judge, Bhagalpur in Sessions Trial No.1148 of 2006/Trial No.468 of 2015 by which they have been convicted under Section 323/149 of the
Patna High Court CR. APP (SJ) No.1861 of 2018 (4) dt.27-09-2018 2/2 Indian Penal Code.
After some arguments, Mr. Subodh Prasad, learned counsel appearing for the appellants submitted that since the appellant have already been granted benefits under the Act, he would not press the appeal on merits.
In view of the submission made above, the appeal is disposed of.
