The petitioner prays for bail in Sono P.S. Case No. 131 of 2016 registered under sections 272/273 IPC including diverse provisions of the Bihar Excise (Amendment) Act, 2016. The police intercepted a vehicle on which the two petitioners were seated. They tried to flee away, but were caught. On a search made of the vehicle, several bottles of India-made foreign liquor were recovered.

The contention of the petitioners is that they are in custody since 05.09.2016 having no previous antecedents of having committed any such offence. If granted the privilege of bail, they shall not indulge themselves in commission of crime

Patna High Court Cr.Misc. No.47794 of 2016 (3) dt.07-12-2016 2/2 of similar nature. The charge-sheet in the case has already been submitted.

Looking to the facts and circumstances of the case, the petitioners above named shall be released on bail on furnishing bail bond of Rs. 10,000/- each, with two sureties of the like amount each, to the satisfaction of CJM, Jamui in Sono P.S. Case No. 131 of 2016 on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, the petitioners shall appear in person on each date fixed at the trial. In case they dodge their appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds and secure their arrest in accordance with law. In addition to above conditions, during the subsistence/currency of the privilege of this bail if the petitioners are found involved in any offence of similar nature, the same shall be construed as a breach of condition of bail entailing cancellation of their bail bonds.
