Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 I.P.C.and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Recovery of liquor is alleged from the field side and not from conscious possession of the petitioner. Petitioner was not there at the time of recovery. Petitioner has got no criminal antecedent. He is in custody since 07.09.2020 wrongly stated in para-15 as 23.06.2020. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.38354 of 2020(2) dt.12-02-2021 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Jaynagar Police Station Case No.175 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
