JUSTICE SANDEEP KUMAR ORAL ORDER 18-01-2023 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Motihari Town in P.S. Case No. 461 of 2016 registered for the offence under Section 386 of the Indian Penal Code.

The allegation against the petitioner is of demand of extortion and he has 14 criminal antecedents. Learned senior counsel appearing for the petitioner has tried to convince this Court by stating that the petitioner is in custody since 2017 in connection with other cases and therefore, he may be granted bail.

Patna High Court CR. MISC. No.41846 of 2022(3) dt.18-01-2023 2/2 Learned counsel for the State submits that in view of the antecedents, he should not be granted bail. In view of the facts and considering the criminal antecedents as mentioned above, this Court is not inclined to grant bail to the petitioner.

The District Judge, Motihari is directed to transfer all the cases in which the petitioner is facing trial in a particular Court having jurisdiction to try those cases and will get the trial concluded expeditiously on day to day basis.

With the aforesaid direction, the application for bail of the petitioner is rejected.
