This application is for grant of regular bail in connection with Ram Krishna Nagar P.S.Case No.114 of 2016, G.R.No.3387 of 2016 for the offences punishable under Sections 394 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the F.I.R. and his name transpired on the basis of confessional statement of the coaccused, however, nature of the case is quite serious as the accused persons entered inside the shop of the brother-in-law of the informant with an intention to commit robbery and in course of that they have caused death of the brother-in-law of the informant. Submission of the learned counsel for the petitioner is that there is nothing against the petitioner and he is in custody for

Patna High Court Cr.Misc. No.32098 of 2017 (3) dt.26-07-2017 2/2 about ten months.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that he is accused in three other cases also of similar type of nature.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months.

With the aforesaid observation, this application is dismissed.
