JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/323/341/353/504/506/34 of the Indian Penal Code and 3/4 of The Prevention of Damage to Public Property Act, 1984. The prosecution case as per the written report of SHO, Rajeev Nagar is that accused persons were facilitating the construction work on the acquired land of Bihar State Housing Board, when police reached there the mob made protest by blocking the road.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and the petitioner has been roped in the present case only on suspicion whereas co-accused Rajeev Ranjan has been granted anticipatory bail by a co-ordinate
Patna High Court Cr.Misc. No.33961 of 2015 (2) dt.14-08-2015 2/2 bench of this court vide Criminal Miscellaneous No.23594 of 2015. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Rajeev Nagar P.S. Case No.9 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
