JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273/308 of the Indian Penal Code and Sections 36/30/34/38 of the Bihar Prohibition and Excise Act, 2016.

The prosecution allegation is that huge quantity of liquor was unloaded at the door of co-accused Ram Chandra Chaudhary.

The petitioner was alleged to be a business partner of Ram Chandra Chaudhary. The petitioner is in custody since 31.03.2017. Co-accused Ram Chandra Chaudhary has already allowed bail by a coordinate Bench of this Court and has

Patna High Court Cr.Misc. No.24078 of 2017 (3) dt.03-07-2017 2/2 been ordered to be released on completion of three months of custody in Cr. Misc. No.25363 of 2017. The petitioner has also completed the aforesaid period of custody.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Siwan/Successor Court, in connection with G.B. Nagar P.S. Case No.91 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
