Petitioner seeks bail in a case registered under section 307 and other minor sections of the Indian Penal Code and 27 of the Arms Act.
Petitioner along with other accused is said to have assaulted the informant and two others. Informant as well as his brother, namely, Ramanand Paswan sustained several injuries including grievous injury. Informant sustained grievous injury on his shoulder whereas his brother, namely, Ramanand Paswan, sustained grievous injury on his right knee. One injured Vibha Kumari sustained simple injury. The alleged occurrence is said to have taken place on account of fixing of a handpipe.
Submission on behalf of the petitioner is that having more or less similar allegation co-accused Shivalak Paswan @ Shivbalak
Patna High Court Cr.Misc. No.38484 of 2016 (2) dt.17-09-2016 Paswan has already been admitted to anticipatory bail by a coordinate bench of this court vide order dated 2.9.2016 passed in Cr. Misc. no. 31664/2016 whereas petitioner is in jail custody since 17.7.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties and also to maintain parity of justice, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Sare P.S. Case no. 46/2016.
