The petitioner seeks bail in Bagaha (Pathkhauli) P.S. case No. 488 of 2016 under Section 302, 201/34 of the Indian Penal Code.

The brother of the deceased alleged that his sister was married to Balaeshwar Yadav three years ago but his sister was killed by her husband and other in-laws due to non fulfillment of demand of additional dowry.

The learned counsel for the petitioner submits that petitioner is maternal uncle of the husband of the deceased. The petitioner is living in his own house far away from the place of occurrence. He has no manner of concern with the family affairs

The learned Additional Public Prosecutor, however, opposed the prayer for bail.

It appears that petitioner is maternal uncle of the husband of deceased. No specific allegation is made against the petitioner. The petitioner is in jail since 31.01.2017. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in Bagaha (Pathkhauli) P.S. Case No. 488 of 2016.
