JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is an accused in Lakhnour P.S. Case No.146 of 2016/G.R.No.1290 of 2016 registered under Sections 341, 323, 504, 498(A), 494,34 of the I.P.C. and Sections 3⁄4 of the Dowry Prohibition Act.

The accusation against the petitioner is of demand of dowry a sum of Rs.1,00,000/- and one motorcycle and on account of non-fulfillment of the demand the victim lady was confined in a room and assaulted.

The submission of the petitioner is that his marriage with the victim took place before nine months they have been blessed with a son. As such Section 3⁄4 of the D.P.Act is not

Patna High Court Cr.Misc. No.53646 of 2016 (2) dt.21-12-2016 2/2 attracted in this case. Moreover, petitioner is ready to keep the victim as his wife with full dignity and honour. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., Jhanjharpur, Madhubani, in Lakhnour P.S.
