JUSTICE SANJAY PRIYA ORAL ORDER 26-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 68 of 2017 arising out of Kishanganj (Mahila) P.S. Case 41 of 2016 instituted for the offence under Sections 323, 376, 379 and 307 of the Indian Penal Code.
It has been submitted that informant has already been examined in the court below in which she has not levelled any allegation against this petitioner in her evidence before the court. The evidence of the victim girl recorded in the court below in Sessions Trial No. 68 of 2017 has been annexed as Annexure-2. Petitioner is said to be in custody since 13.01.2017. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.30445 of 2017 (3) dt.26-07-2017 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Assistant Sessions Judge, Kishanganj, in connection with Kishanganj (Mahila) P.S. Case No. 41 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. The petitioner will cooperate in conclusion of the trial and he will remain present on each and every date of trial till disposal of the case and will not tamper the witnesses or cause the delay in trial. In the event of default of two consecutive dates, his bail bonds will be liable to be cancelled.
